1.Introduction and Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the website https://rakshanatv.com and any associated pages, forms, streams, applications and services (collectively, the "Platform") operated by Rakshana TV Private Limited, a public charitable trust having its registered office at RBI Colony, Kavadiguda, Hyderabad, Telangana 500020 (the "Trust", "we", "us" or "our"), which broadcasts and publishes content under the name "Rakshana TV".

These Terms constitute a legally binding electronic agreement between you and the Trust under the Information Technology Act, 2000 and the rules made thereunder. They do not require any physical, electronic or digital signature to be enforceable.

By accessing the Platform, browsing any page, watching any broadcast, submitting any form, making any booking or offering any donation, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, you must stop using the Platform immediately.

2.Definitions

In these Terms, unless the context requires otherwise:

Content

all television programmes, episodes, live broadcasts, sermons, songs, podcasts, workshops, testimonies, images, graphics, logos, text, schedules and other material made available on or through the Platform.

Donation

a voluntary, gratuitous contribution of money offered to the Trust through the Platform, made without expectation of any goods, services or consideration in return.

Prayer Request

a request submitted through the Platform asking the Trust's prayer team to pray for a stated matter.

Slot Booking Request

an application submitted through the Platform seeking to reserve broadcast airtime on a Rakshana TV channel or stream.

Booking

a request submitted through the Platform to attend or reserve places at an event organised or hosted by the Trust.

User

any person who accesses or uses the Platform in any manner, whether or not that person submits any information to us.

Personal Data

has the meaning given to it in the Digital Personal Data Protection Act, 2023.

3.Eligibility and Capacity

You may use the Platform only if you are competent to contract under Section 11 of the Indian Contract Act, 1872, that is, if you are at least 18 years of age, of sound mind, and not disqualified from contracting by any law to which you are subject.

Passive viewing of publicly available Content is open to all. However, you must not submit any form, Prayer Request, Slot Booking Request, Booking or Donation through the Platform if you are under 18 years of age, unless a parent or lawful guardian does so on your behalf and takes responsibility for it. Where we process the Personal Data of a child, we do so only with verifiable consent of a parent or lawful guardian, in accordance with Section 9 of the Digital Personal Data Protection Act, 2023.

If you use the Platform on behalf of an organisation, church, ministry or other entity, you represent that you are authorised to bind that entity to these Terms.

4.Nature of the Service

The Trust is a faith-based, non-profit charitable organisation. The Platform exists to broadcast and make available Christian devotional, teaching, worship and community Content, to receive Prayer Requests, to allow applications for broadcast airtime, to publicise events, and to receive voluntary Donations in support of the Trust's charitable and religious objects.

The Content is offered for spiritual encouragement and general information only. It is not, and must never be relied upon as, professional advice.

Testimonies published on the Platform describe the personal experiences of the individuals concerned. They are not claims of typical results and are not a promise, guarantee or assurance that any similar outcome will occur for you.

The Trust does not charge for access to the Content. Availability of live broadcasts and streams depends on third-party distribution platforms, satellite and cable operators, and your own internet connection, and may be interrupted, delayed, rescheduled or discontinued without notice.

5.Prayer Requests

When you submit a Prayer Request you may provide your name, mobile number, email address, location and a free-text message describing the matter you wish us to pray for. Only the fields marked as mandatory are required.

Prayer Requests are received and read by the Trust's prayer team. We treat them as confidential and we do not publish, sell, rent or trade the contents of a Prayer Request. We will not disclose your Prayer Request to any third party except where you have expressly asked us to, or where we are compelled to do so by law or by a lawful order of a court, tribunal or government authority having jurisdiction.

You should be aware, and you accept, that the message field of a Prayer Request is free text and that you decide what to put in it. Please share only what you are comfortable sharing.

• Do not submit a Prayer Request containing information about another identifiable living person — particularly information about their health, family circumstances or beliefs — unless that person has consented to you doing so.
• Do not use a Prayer Request to report an emergency, a crime, a threat to life, or an ongoing situation of abuse or self-harm. Prayer Requests are not monitored continuously and there is no guaranteed response time. Contact the police, a medical service, or an appropriate helpline instead.
• Do not submit financial credentials, bank details, passwords, one-time passwords, or identity document numbers in a Prayer Request. We will never ask you for these.

We pray for the requests we receive, but we do not promise, guarantee or warrant any particular outcome, healing, result or response, whether temporal or spiritual. Submitting a Prayer Request creates no contractual obligation on the Trust.

We may retain a Prayer Request for our internal pastoral records. You may ask us to erase it at any time using the contact details in the Grievance Redressal section below.

6.Broadcast Slot Booking

The Platform allows you to submit a Slot Booking Request expressing interest in reserving broadcast airtime. You may be asked for your name, mobile number, email address, location, the dates and times you are seeking, and a message describing your requirement.

The Trust reserves the absolute right to accept, decline, defer, reschedule, shorten, pre-empt or cancel any slot, in whole or in part, at its sole discretion, including where it considers this necessary for editorial, technical, doctrinal, regulatory or scheduling reasons, and it is not required to give reasons for doing so.

If a slot is confirmed, you are solely responsible for the material you supply for broadcast, and you warrant that:

• you own or are validly licensed to broadcast all content, music, footage, images and marks in the material, and that broadcasting it will not infringe any third party's intellectual property or other rights;
• the material complies with all applicable Indian law, including the Cable Television Networks (Regulation) Act, 1995 and the Programme Code made thereunder, the Information Technology Act, 2000, and any applicable advertising standards;
• the material does not contain anything defamatory, obscene, fraudulent, misleading, hateful, or likely to incite violence or communal disharmony; and
• the material contains no solicitation of money on your own behalf that is presented as if it were a solicitation by the Trust.

You agree to indemnify the Trust against any claim, demand, proceeding, penalty, loss or cost arising out of material you supplied for broadcast. The Trust may refuse to broadcast, or may withdraw mid-broadcast, any material it considers to breach these warranties, without refund and without liability.

7.Events and Bookings

The Trust may publicise events and allow you to request places at them through the Platform. You may be asked for the number of places, the names of attendees, and contact details for the person making the Booking.

A Booking is confirmed only when the Trust confirms it to you. The Trust may limit the number of places per person, may cancel, postpone, relocate or change the programme of any event, and may refuse admission or require a person to leave where their conduct is disruptive, unlawful, or unsafe.

Where an event is free of charge, no refund can arise. Where a charge applies, the refund position for that event will be stated at the time of Booking, and that stated position will prevail over any general statement on the Platform.

You are responsible for your own travel, accommodation and incidental costs, and for the supervision of any child you bring to an event. The Trust does not accept liability for those costs if an event is changed or cancelled.

8.Donations

Donations sustain the Trust's broadcasting and charitable work. They are entirely voluntary. You are under no obligation to donate, and access to the Content is not conditional on donating.

Every Donation is a gratuitous contribution. It is not a payment for goods or services, it purchases no membership, entitlement, priority, airtime, blessing, healing, intercession or any other benefit, and it confers no right to direct how the Trust applies its funds. The Trust applies Donations towards its charitable and religious objects at the discretion of its trustees.

Refunds and corrections. Because a Donation is a completed gift, it is non-refundable once received and applied. The Trust will, however, consider a request to reverse a Donation in the following limited circumstances, provided you contact us within seven (7) days of the transaction with the transaction reference:

1. 1the same Donation was charged more than once due to a technical or duplicate-submission error;
2. 2an amount materially different from the amount you authorised was debited;
3. 3the amount was debited from you but the transaction failed and the Donation was never received by the Trust; or
4. 4the Donation was made through the demonstrable unauthorised use of your payment instrument.

Where an approved reversal is made, it will be credited to the original payment instrument. The time taken for the credit to appear depends on your bank or payment provider and is outside the Trust's control. The Trust does not reverse a Donation on the ground that you have changed your mind.

Payment processing. Any online Donation is processed by an authorised third-party payment gateway. Your use of that gateway is additionally governed by the gateway's own terms and privacy policy, and the Trust is not responsible for the gateway's acts, omissions, outages or security. The Trust does not receive, process or store your card number, CVV, UPI PIN, net-banking credentials or any other payment credential at any time.

Tax. The Trust makes no representation, and gives no assurance, that a Donation is eligible for a deduction under Section 80G of the Income-tax Act, 1961 or under any other provision. Any statement about the tax treatment of a Donation will be made only in a receipt issued by the Trust, and you should rely on your own tax adviser.

You confirm that any funds you donate are lawfully yours, are from a lawful source, and are not the proceeds of crime within the meaning of the Prevention of Money-Laundering Act, 2002. The Trust may decline or return any Donation, without giving reasons.

9.Acceptable Use and Prohibited Conduct

You agree to use the Platform lawfully and respectfully. You must not host, display, upload, submit, publish, transmit or share, through any form or facility on the Platform, any information which:

• belongs to another person and to which you do not have a right;
• is obscene, pornographic, paedophilic, invasive of another's privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, or otherwise inconsistent with or contrary to the laws of India;
• is defamatory, libellous, threatening, abusive, or promotes hatred, enmity or violence between groups on grounds of religion, caste, community, region, language or any other ground;
• is harmful to a child;
• infringes any patent, trademark, copyright or other proprietary right;
• deceives or misleads the recipient about the origin of the message, or knowingly and intentionally communicates any information which is patently false or misleading in nature;
• impersonates another person, or falsely states or misrepresents your affiliation with the Trust, its trustees, its speakers or its prayer team;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents the investigation of any offence, or insults any foreign State;
• contains a software virus, worm, or any other computer code, file or programme designed to interrupt, destroy or limit the functionality of any computer resource; or
• is patently false or untrue, and is written or published in any form with the intent to mislead or harass a person, entity or agency for financial gain, or to cause any injury to any person.

This list reflects the categories of prohibited information set out in Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

You must also not:

• copy, record, re-broadcast, re-upload, mirror, stream, distribute, sell or publicly perform any Content, in whole or in part, without our prior written permission;
• use any robot, spider, scraper, crawler or automated means to access, harvest or index the Platform or the personal information of any User;
• circumvent, disable, probe, scan or test the vulnerability of any security, authentication or access-control feature of the Platform, or attempt to gain unauthorised access to the administrative interface, any account, any server or any database;
• impose an unreasonable or disproportionately large load on our infrastructure, or interfere with the proper working of the Platform;
• submit any form through the Platform repeatedly, in bulk, or with false, spam or automated content; or
• use the Platform or any Content for any commercial purpose, or to solicit money, goods or services from other Users.

Unauthorised access to a computer resource is an offence under Section 43 and Section 66 of the Information Technology Act, 2000, and publication or transmission of obscene material in electronic form is an offence under Sections 67, 67A and 67B of that Act. We will report conduct we believe to be criminal to the appropriate authorities and will cooperate with any lawful investigation.

10.Intellectual Property

All Content on the Platform, and the compilation, arrangement, design, look and feel of the Platform itself, is owned by or licensed to the Trust and is protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws. The name "Rakshana TV", the Rakshana TV logo, and all related names, marks and designs are the property of the Trust.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Content for your own private, non-commercial, devotional use. This licence does not permit you to download, record, reproduce, adapt, translate, subtitle, re-upload, monetise, or make the Content available on any other platform, channel, service or medium.

Nothing on the Platform transfers any ownership right to you. All rights not expressly granted are reserved.

Content you submit. You retain ownership of anything you submit to us. By submitting it, you grant the Trust a royalty-free, worldwide licence to use it solely for the purpose for which you submitted it — to pray for your request, to process your booking, or to respond to your message. We will not publish or broadcast your submission, or use your name, image or testimony in our promotional material, without your separate and specific prior consent.

Copyright complaints. If you believe that Content on the Platform infringes your copyright or other right, write to the Grievance Officer named below with details identifying the work, the location of the material complained of, and a statement of your right. We will act on valid complaints promptly.

11.Third-Party Platforms and Links

The Platform links to and embeds third-party services, including video platforms, mobile app stores, social media networks, direct-to-home and cable television operators, and a payment gateway. These are provided for your convenience.

The Trust does not own, operate or control these third-party services. We do not endorse them, we are not responsible for their content, availability, terms, advertising or privacy practices, and we accept no liability for any loss arising from your use of them. Once you leave the Platform by following a link, or once you view our Content on a third-party service, that third party's own terms and privacy policy govern your use of it.

12.Availability, Changes and Suspension

The Platform is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, timely, error-free, secure, or free of viruses or other harmful components, or that any defect will be corrected.

We may at any time, without notice and without liability, modify, suspend, withdraw or discontinue the Platform or any part of it, change or remove any Content, alter our programming schedule, or impose limits on certain features.

We may suspend or terminate your access to the Platform, or refuse to accept any submission, request, booking or Donation from you, immediately and without notice, if we reasonably believe you have breached these Terms or applicable law, or that your conduct may harm the Trust, its staff, its volunteers or other Users.

13.Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Trust disclaims all warranties, conditions, representations and terms of any kind, whether express, implied or statutory, in relation to the Platform and the Content, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement and quiet enjoyment.

The Trust does not warrant that the Content is accurate, complete, current or suitable for your circumstances. Programme schedules, event details, speaker listings and slot availability are indicative and may change without notice.

14.Limitation of Liability

To the fullest extent permitted by applicable law, the Trust, its trustees, officers, employees, volunteers, prayer team members, contractors and agents shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss or damage, or for any loss of profit, revenue, goodwill, opportunity, data or anticipated saving, arising out of or in connection with your use of, or inability to use, the Platform or the Content, whether the claim is framed in contract, tort, negligence, strict liability, statute or otherwise, and whether or not the Trust was advised of the possibility of such loss.

To the fullest extent permitted by applicable law, the total aggregate liability of the Trust to you, in respect of all claims arising out of or in connection with the Platform, shall not exceed the total amount actually paid by you to the Trust in the twelve (12) months immediately preceding the event giving rise to the claim, or one thousand Indian Rupees (INR 1,000), whichever is higher.

Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited under Indian law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

15.Indemnity

You agree to indemnify, defend and hold harmless the Trust, its trustees, officers, employees, volunteers and agents from and against any and all claims, demands, proceedings, liabilities, damages, penalties, costs and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms or of any applicable law; (b) any material or information you submitted to or through the Platform, including material supplied for broadcast; (c) your infringement of any third party's intellectual property, privacy or other right; or (d) your misuse of the Platform.

16.Force Majeure

The Trust shall not be liable for any failure or delay in performing any obligation under these Terms where that failure or delay results from any cause beyond its reasonable control, including act of God, flood, fire, earthquake, epidemic or pandemic, war, terrorism, riot, civil disturbance, strike, act or order of government or regulator, failure of a satellite, cable, telecommunications, internet or power service, cyber-attack, or failure of a third-party platform or payment gateway.

17.Grievance Redressal and Contact

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Section 13 of the Digital Personal Data Protection Act, 2023, the Trust has designated a Grievance Officer to receive and resolve complaints from Users concerning the Platform, its Content, and the handling of Personal Data.

Please include your name, your contact details, a clear description of your complaint, the URL of the page or Content concerned, and any supporting material. We will acknowledge your complaint within twenty-four (24) hours of receipt and will endeavour to resolve it within fifteen (15) days of receipt.

If you are dissatisfied with the outcome of your complaint about the handling of your Personal Data, you may escalate the matter to the Data Protection Board of India under the Digital Personal Data Protection Act, 2023.

18.Changes to These Terms

We may revise these Terms from time to time, for example to reflect a change in our services, in the law, or in our practices. The revised Terms take effect from the date they are published on this page, and the “last updated” date at the top of this page will change.

Your continued use of the Platform after the revised Terms are published constitutes your acceptance of them. We encourage you to review this page periodically. Where a change materially affects your rights, we will take reasonable steps to bring it to your attention.

19.General Provisions

Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Waiver

No failure or delay by the Trust in exercising any right under these Terms operates as a waiver of that right, and no single or partial exercise of any right prevents its further exercise.

Assignment

You may not assign or transfer your rights or obligations under these Terms. The Trust may assign its rights and obligations to a successor entity or on any reorganisation of the Trust.

Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Trust in relation to the Platform, and supersede all prior understandings in relation to it.

No partnership

Nothing in these Terms creates any partnership, joint venture, agency, employment or franchise relationship between you and the Trust.

Survival

The sections concerning Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnity, and Governing Law survive any termination of your use of the Platform.

20.Governing Law, Jurisdiction and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including a non-contractual dispute or claim), are governed by and shall be construed in accordance with the laws of India, without regard to any conflict-of-laws principle.

Subject to the arbitration provision below, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, and you irrevocably submit to that jurisdiction.

Before commencing any proceeding, the parties shall first attempt in good faith to resolve the dispute amicably by writing to the Grievance Officer. If the dispute is not resolved within thirty (30) days of that notice, it shall be referred to and finally resolved by arbitration by a sole arbitrator appointed by the Trust, in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad, Telangana, India, and the language of the arbitration shall be English. The arbitral award shall be final and binding on the parties.
